From Manny: Working the dealer side of the desk taught me one thing — buyers who walk in knowing their state’s rules walk out with a cleaner deal. This is every Virginia rule my $49 Deal Audit checks against your paperwork. Every citation links to the primary source. No sponsors, no dealer money, no filter.

Last verified 2026-09-14 · every numeric claim independently fact-checked against primary sources · items marked “Not yet verified” are being sourced, never guessed.

1. Documentary Fee / Dealer Processing Charge

Virginia doc fee: no statutory cap — typical fee about $799 (market estimate, not a legal limit; see note below)

Virginia sets no statutory dollar cap on the dealer ‘processing fee,’ but disclosure is heavily regulated: the fee must be clearly and conspicuously disclosed on a sign in the dealership’s public sales area and itemized on the buyer’s order (Va. Code § 46.2-1530). Every tax and fee must be individually listed and identified. Market norm figure is an estimate (VA processing fees commonly run $400-$999) and was not corroborated by primary sources; the processing fee is included in the taxable gross sales price. adversarial review cautioned that ‘no cap’ does not mean ‘anything goes’ — fee presentation is constrained by advertising rules and VCPA deceptive-pricing principles.

2. Virginia Attorney General Consumer Protection Division

Phone: (800) 552-9963

Complaint URL: https://www.oag.state.va.us/consumer-protection

Division name: Virginia Office of the Attorney General, Consumer Protection Section

3. Virginia Consumer Protection Statute

Statute: Va. Code §§ 59.1-196 through 59.1-207

Short name: VCPA

Long name: Virginia Consumer Protection Act

Statute URL: https://law.lis.virginia.gov/vacodefull/title59.1/chapter17/

4. Sales Tax on Used Vehicle Purchase

Method: motor vehicle sales use tax

Taxable base: gross sales price with no trade-in deduction; tax is the greater of 4.15% or $75 (Va. Code § 58.1-2402)

Rate: 4.15%

Virginia Motor Vehicle Sales and Use Tax (SUT) of 4.15% collected at time of titling by DMV, not the general retail sales tax. Gross sales price includes the dealer processing fee and does NOT allow trade-in credit. Verified against primary sources.

5. Virginia Lemon Law

Statute: Va. Code § 59.1-207.9 et seq. (Motor Vehicle Warranty Enforcement Act)

Repair attempts threshold: 3

Days-out-of-service threshold: 30

Notice deadline: Consumer must notify manufacturer of the nonconformity within 18 months of vehicle delivery (the ‘lemon law rights period’)

6. Title Brand Disclosure

Statute: Va. Code § 46.2-1600 et seq.

Virginia requires permanent title branding for salvage, flood-damaged, and rebuilt vehicles. A vehicle is ‘salvage’ if, among other definitions, estimated repair cost exceeds 75% of actual cash value. Rebuilt vehicles must pass state safety inspection before a new (branded) title issues. Specific dealer point-of-sale disclosure mechanics were not fully verified against primary sources. https://law.lis.virginia.gov/vacodefull/title46.2/chapter16/

7. Vehicle Service Contract (VSC) Regulation

Registration required: Not yet verified

primary-source research marked Virginia vehicle service contract registration/reserve requirements UNCLEAR (Title 59.1 sections not located in results) and no other source clarified. Do not assert registration or reserve requirements without primary-source verification of Va. Code Title 59.1 extended service contract provisions and Bureau of Insurance guidance.

8. GAP Insurance Regulation

Markup cap: Not yet verified

primary-source research’s GAP research was truncated/UNCLEAR and no other source corroborated any markup cap or registration requirement. Requires primary-source verification (Virginia Bureau of Insurance / Title 38.2, and GAP waiver provisions if any).

9. Auto Broker / Dealer License Requirement

Special license required: Not yet verified

Not addressed by any of the three research sources. Requires verification against Va. Code Title 46.2 Chapter 15 (Motor Vehicle Dealer Board licensing categories).

10. Language Disclosure Requirement

Statute: No state statute equivalent to Cal. Civ. Code § 1632

Spanish disclosure required if negotiated in Spanish: No

Not addressed by any of the three research sources. No Virginia-specific Spanish-language contract disclosure requirement was verified.

11. Recording Law — Consent for F&I Office Recording

Consent type: one-party

Statute: Va. Code § 19.2-62

Virginia is generally understood to be a one-party consent state under Va. Code § 19.2-62. CAUTION: this item was not fully verified in current research pass in this synthesis and should be re-verified against the primary statute before customer-facing use. https://law.lis.virginia.gov/vacode/title19.2/chapter6/section19.2-62/

12. Statute of Limitations for Consumer Disputes

Virginia statute of limitations: 2 years
